Holiday Photos Official Contest Rules

Please read before entering contest.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. VALID IN THE 50 STATES AND THE DISTRICT OF COLUMBIA OF THE UNITED STATES, EXCEPT WHERE PROHIBITED. ENTRY REQUIRES INTERNET ACCESS. THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, FACEBOOK®, TWITTER® OR INSTAGRAM®. ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

The Holiday Photo Contest (the "Contest") is a contest where Individuals are invited to submit their "Entry," which can be defined as a post on Facebook, Twitter or Instagram that includes, but is not limited to, the #ThisIsLakeview hashtag and a photo or video taken in the photo backdrop located at 3410 N. Southport Ave. An "Individual" is a natural person a) residing in the United States, b) who is at least 18 years of age with a Facebook, Twitter and/or Instagram account in good standing. "Entrant," "You," and "Your" means any Individual who enters this Contest in accordance with the Rules set forth below. The Entries will be evaluated using the criteria outlined below. Prize(s) will be awarded to Entrants whose entries best meet the criteria in the Lakeview Chamber of Commerce's sole discretion. See below for the complete details.

1. Agreement to Rules: By participating, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Lakeview Chamber of Commerce (the "Chamber") as final and binding as it relates to the content. The Contest is subject to all applicable federal, state and local laws.

2. Contest Period: Entries will be accepted online starting Wednesday, November 22, 2017 and ending Sunday, December 31, 2017. All online entries must be received by 11:59PM CST Sunday, December 31, 2017.

3. How to Enter: By submitting an entry, You agree that you have read, understand, and agree to these Contest Rules. Entrants agree that the Chamber has the sole right to decide all matters and disputes arising from this Contest and that all decisions of the Chamber are final and binding.

Facebook Entry: To enter the Contest via Facebook, Entrant must be a registered member of Facebook with an account in good standing. To become a registered member of Facebook (registration is free), go to www.facebook.com and follow the instructions to become a registered member and create an account ("Facebook Account"). Once registered, to enter an Entrant must: (a) Post a photo or video that shows the photo backdrop located at 3410 N. Southport Ave.; and (b) includes the hashtag #ThisIsLakeview in the tweet to receive an automatic entry ("Entry or Entries") into the Contest. All Submissions must be received by December 31, 2017 at 11:59:59 PM CST (the "Submission Deadline"). All Submissions must meet the standards set out in these Official Rules including, but not limited to, the Entry Terms and Entry Content Restrictions (specified below). The Chamber reserves the right in its sole and unfettered discretion to disqualify any entry that it believes contains inappropriate content, that does not comply with these Official Rules, or that is not consistent with the spirit or theme of the Contest. Entrants must adjust their Facebook account settings to allow for viewing of Entries and receipt of Messages from the Chamber. For this purpose, Entrants will have to set their Facebook post and account settings to 'Public', and take any further necessary steps to ensure receipt of any communication from the Chamber. It is solely Entrant's burden to take any steps necessary to adjust their Facebook account settings so that photo or video Entries may be viewed by, and messages can be sent by, the Chamber. An Entrant's non-receipt of a message from the Chamber for any reason, including for failure on behalf of Entrant to adjust Facebook account settings, shall be Entrant's, and not the Chamber's, fault. Similarly, the Chamber shall not be held liable if they are not able to view an Entrant's entry for any reason, including the failure on behalf of Entrant to adjust their Facebook account settings accordingly. Twitter Entry: To enter the Contest via Twitter, Entrant must be a registered member of Twitter with an account in good standing. To become a registered member of Twitter (registration is free), go to www.twitter.com and follow the instructions to become a registered member and create an account ("Twitter Account"). Once registered, to enter an Entrant must: (a) Post a photo or video that shows the photo backdrop located at 3410 N. Southport Ave.; and (b) includes the hashtag #ThisIsLakeview in the tweet to receive an automatic entry ("Entry or Entries") into the Contest. All Submissions must be received by December 31, 2017 at 11:59:59 PM CST (the "Submission Deadline"). An Entrant's non-receipt of a message from the Chamber for any reason, including for failure on behalf of Entrant to adjust Twitter account settings, shall be Entrant's, and not the Chamber's, fault. Similarly, the Chamber shall not be held liable if they are not able to view an Entrant's entry for any reason, including the failure on behalf of Entrant to adjust their Twitter account settings accordingly. Instagram Entry: To enter the Contest via Instagram, Entrant must be a registered member of Instagram with an account in good standing. To become a registered member of Instagram, download one of Instagram's mobile apps and follow the instructions to create an account ("Instagram Account"). Registering for an Instagram Account is free. Once registered, to enter an Entrant must: (a) Post a photo or video on Instagram that shows the photo backdrop located at 3410 N. Southport Ave.; and (b) include the hashtag #ThisIsLakeview in the caption of their photo or video to receive an automatic entry ("Entry or Entries") into the Contest. All Submissions must be received by December 31, 2017 at 11:59:59 PM CST (the "Submission Deadline"). Entrants must adjust their Instagram account settings to allow for viewing of Entries and receipt of Messages from the Chamber. For this purpose, Entrants will have to set their Instagram and account settings to 'Public', and take any further necessary steps to ensure receipt of any communication from the Chamber. It is solely Entrant's burden to take any steps necessary to adjust their Instagram account settings so that photo or video Entries may be viewed by, and messages can be sent by, the Chamber. An Entrant's non-receipt of a message from the Chamber for any reason, including for failure on behalf of Entrant to adjust Instagram account settings, shall be Entrant's, and not the Chamber's, fault. Similarly, the Chamber shall not be held liable if they are not able to view an Entrant's entry for any reason, including the failure on behalf of Entrant to adjust their Instagram account settings accordingly. There is no limit to the number of Entries that Entrants may submit. Entrants must be 18 years old by the Entry deadline stated below. Not valid where prohibited. Employees, contractors, subcontractors, officers or directors of the Chamber are not eligible to compete.

4. Winner selection and notification: Winners of the Contest will be selected at the sole discretion of the Chamber at the conclusion of the contest. Winners will be notified via the Facebook, Twitter or Instagram account used to Enter. The Chamber shall have no liability for a winner's failure to receive notices due to winners' spam, junk email or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.

The Chamber may change the rules, criteria, or prizes at any time at its sole discretion. Winners must arrange a time to pick up the prize at the Lakeview Chamber of Commerce office, 1409 W. Addison St., Chicago, IL 60613, unless otherwise notified by the Chamber.

The receipt by winner of the prize offered in this Contest is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE CONTEST AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

5. Prizes: The prize (the "Prize") is one (1) Lakeview Gift Card valued at $100. Prize will be awarded "as is" with no warranty or guarantee express or implied by the Chamber. Winners may not substitute, assign or transfer any Prize or part thereof, or redeem Prize for cash. Further, the Chamber reserves the right to forfeit or award any unclaimed or leftover Prize at its sole discretion. Additional restrictions may apply. Gift cards are subject to the terms of the gift card issuer. All expenses not specified herein are the Winner's responsibility. Taxes on and in connection with any Prize are the sole responsibility of the Winner.

6. Businesses: The businesses (the "Businesses") that accept the Lakeview Gift Card are listed in full at shopdinelakeview.com. Businesses are subject to change.

7. Choice of Law and Recourse to Judicial Procedures: These Rules shall be governed by, subject to, and construed in accordance with the laws of the State of Illinois, United States of America, excluding all conflict of law rules. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and all participants or Entrants expressly waive any and all such rights.
